We at ParentPowered know you care about how your personal information is used and shared, and we take your privacy seriously. Please read the following to learn more about our Privacy Policy. By using or accessing the Services in any manner, you acknowledge that you accept the practices and policies outlined in this Privacy Policy and you hereby consent that we will collect, use, and share your information in the following ways.

Remember that your use of ParentPowered’s Services is at all times subject to the Terms of Use, which incorporates this Privacy Policy. Any terms we use in this Policy without defining them have the definitions given to them in the Terms of Use or the Educational Institutions Terms.

What does this Privacy Policy cover?

This Privacy Policy explains how ParentPowered collects and uses information from its Services, including our treatment of personally identifiable information ("Personal Information") that we gather when you are accessing or using our Services. We gather various types of Personal Information from our users, as explained in more detail below, and we use this Personal Information internally in connection with our Services, including to personalize, provide, and improve our Services, to allow you to set up a user account and profile, to contact you, to fulfill your requests for certain products and services, and to analyze how you use the Services. In certain cases, we may also share some Personal Information with third parties, but only as described below.

As noted in the Terms of Use, we do not knowingly collect or solicit personal information from anyone under the age of 13. If you are under 13, please do not attempt to register for the Services or send any personal information about yourself to us. If we learn that we have collected personal information from a child under age 13, we will delete that information as quickly as possible. If you believe that a child under 13 may have provided us personal information, please contact us at support@parentpowered.com.

What information does ParentPowered collect?

Information You Provide to Us:

In order to deliver ParentPowered text messages and other services ("The Services"), ParentPowered collects Authorized User data and Student data. The data includes personally identifiable information ("Personal Information"), which means information that may identify an individual student or Authorized User. ParentPowered complies with applicable laws, regulations, industry standards, and contracts and agreements pertaining to the safeguarding of Personal Information. The Data are provided by the authorized representative of an organization that has purchased a subscription to use the Services. The two types of Personal Information are:

  1. User data (parents, caregivers, teachers, school administrators), which may include:
    1. Phone number
    2. Email address
    3. Preferred home language
    4. First and last name (optional)
    5. ZIP code (optional) - this helps us to customize the Services to the users' location, e.g. notifications about local library events.
    6. Custom data (optional) - administrators may upload information in order to segment parents into different groups, e.g. school name or class name.

  2. Student data, which may include:
    1. Grade level
    2. Date of birth
    3. Student ID (optional)
    4. First name (optional)
Information Collected Automatically:

Like most websites and online services, we and our third-party partners automatically collect certain types of usage information when you visit our Services, read our emails, or otherwise engage with us. We typically collect this information through a variety of tracking technologies, including cookies, web beacons, file information, and similar technology (collectively, "tracking technologies"). For example, we collect information about your device and its software, such as your IP address, browser type, Internet service provider, platform type, device type, operating system, date and time stamp, a unique ID that allows us to uniquely identify your browser, mobile device, or your account, and other such information. We also collect information about the way you use our Services, for example, the site from which you came and the site to which you are going when you leave our website, the pages you visit, the links you click, how frequently you access the Services, whether you open emails or click the links contained in emails, whether you access the Services from multiple devices, and other actions you take on the Services. When you access our Services from a mobile device, we may collect unique identification numbers associated with your device or our mobile application, mobile carrier, device type, model, manufacturer, and mobile device operating system. We may be able to determine your approximate location by analyzing other information, like an IP address to associate a user with their School. We may also collect analytics data, or use third-party analytics tools, to help us measure traffic and usage trends for the Services. Although we do our best to honor the privacy preferences of our visitors, we are not able to respond to Do Not Track signals from your browser at this time.

How does ParentPowered protect the information?

Your privacy is protected by Federal, State, and local law. ParentPowered has designed and operates its systems to comply with all such laws. We have implemented commercially reasonable safeguards designed to prevent loss, misuse, and unauthorized access, disclosure, or modification of Personal Data provided or collected through ParentPowered's Services.

  1. Data Storage and Security: Your data is stored securely in encrypted servers in the United States. All network traffic is secured by TLS 1.2 or better. These data centers are continuously monitored and audited annually.
  2. Disclosures: The uses and disclosures of Personal Data are in compliance with state and federal laws designed to protect such information. Only authorized individuals, including ParentPowered employees and subcontractors, have access to Personal Data, and their authorization is constantly reviewed. Individuals authorized to have access to Personal Data are limited to only those who need access to that data in order to perform the work necessary under our contractual arrangements with our Subscribers.
  3. Accountability: All ParentPowered employees and subcontractors receive security training, and are accountable for the Security and Privacy of the Personal Data we maintain. This policy applies to all computing systems, networks, business processes, and the verbal transmission of information.
  4. Security Incidents: In the event of a verified security breach that results in an unauthorized release or exposure of Subscriber or Student Data, ParentPowered will take steps to immediately identify and remediate the cause of such Security Incident. ParentPowered shall notify the Users whose data was affected consistent with contract obligations and applicable laws.

When and how does ParentPowered share information?

We share information only for the educational purpose of the work. We do not share Personal Data for advertising or any other use outside of the stated purpose for the Services.

We do not and will not sell user information or data collected from the use of the Services.

We vigilantly review our policies and practices to ensure compliance where required with the Federal Educational Rights and Privacy Act (FERPA) and applicable state laws and regulations. We will not disclose any of the Personal Data we collect to any third parties except in the following limited circumstances:

  1. Disclosures that are necessary to carry out the scope of work. We may use subcontractors to carry out functions within the scope of work when it is in compliance with GDPR, federal, and state law, and with applicable agreements. In such circumstances, the subcontractor is acting as a ParentPowered employee and is required to comply with the privacy and security requirements and safeguards that apply to ParentPowered and all of its employees. This includes all applicable federal laws, state laws and regulations, contractual agreements, and applicable Subscriber policies.
  2. If an Authorized User has registered to use the Services through a school, school district, child care center, Head Start program, or other organization that has purchased a subscription from ParentPowered, the personal data provided will be accessible by the organization that purchased the subscription.
  3. Legally compelled disclosures. We will disclose the data we collect if required to do so by law or in the good-faith belief that disclosure is necessary (a) to obey the law or comply with legal process served on us or our affiliates; (b) to protect and defend our rights or property or the rights or property of other users of our Web site; or (c) to act in an emergency to protect the personal safety of users of our website or the public.
  4. Company acquisition. In the event that our company is acquired, we may share the data with the acquirer to continue to provide services to you. The acquirer will be bound by this Privacy Policy, and we will comply with all contractual agreements with our Subscribers that require us to disclose any acquisition of ParentPowered.
  5. Analytics. We may work with third parties that collect data about your use of the Site and other sites or apps over time for non-advertising purposes. For example, ParentPowered uses Google Analytics to improve the performance of the Site and for other analytics purposes.

What Personal Information can I access?

Through your account settings, you may access, and, in some cases, edit or delete the following information you’ve provided to us:

  • Name and password
  • Email address
  • ZIP code
  • Phone number

The information you can view, update, and delete may change as the Services change. If you have any questions about viewing or updating information we have on file about you, please contact us at support@parentpowered.com.

ParentPowered will use commercially reasonable efforts to comply with written requests from Educational Institutions, parents and legal guardians of students under the age of 18, and students over the age of 18 for access to and review of personally identifiable information in such student’s records accessible to ParentPowered on the Services and to correct any erroneous information within a reasonable period of time, by providing Educational Institutions, parents and legal guardians of students under the age of 18, and students over the age of 18 with the requested personally identifiable information through secure means, such as a secure “FTP site,” to make corrections to erroneous information, which Educational Institutions, parents and legal guardians of students under the age of 18, and students over the age of 18 will then provide to ParentPowered to incorporate with respect to the Service.

Under California Civil Code Sections 1798.83-1798.84, California residents are entitled to contact us to prevent disclosure of Personal Information to third parties for such third parties’ direct marketing purposes; in order to submit such a request, please contact us at support@parentpowered.com.

Will ParentPowered ever change this Privacy Policy?

We’re constantly trying to improve our Services, so we may need to change this Privacy Policy from time to time as well, but we will alert you to changes by placing a notice on the Services, by sending you an email, and/or by some other means. Please note that if you’ve opted not to receive legal notice emails from us (or you haven’t provided us with your email address), those legal notices will still govern your use of the Services, and you are still responsible for reading and understanding them. If you use the Services after any changes to the Privacy Policy have been posted, that means you agree to all of the changes.
